Terms of business (United Kingdom)
Goods are invoiced in £ Sterling at prices prevailing at date of delivery. We must reserve the right to alter or amend our list prices at any time, without previous notice. Owing to market fluctuations it is inevitable that prices may vary from time to time.
Value Added Tax (VAT)
All prices shown are exclusive of VAT which, when applicable, will be added at the prevailing rate.
Smaller goods will be despatched by first class mail or guaranteed special delivery depending on weight and value. Larger orders will be despatched by Interlink. All carriage costs will be added to the invoice.
Returns must be accompanied by documentation (ie Invoice Number, Date of Supply etc.) And will only be accepted if goods are of faulty manufacture or have been incorrectly supplied. Goods supplied correctly against orders will not be accepted as returns, or a surcharge of 15% will be added at our discretion.
Payments (United Kingdom)
Credit will only be given to authorised accounts, cheques accepted if guaranteed, cash with order, most credit and debit cards accepted. Cheques must be made payable to ‘Andy Smith Ltd.’
Overdue accounts will be persued by a debt collecting agency. Interest and all costs will be added to the claim. If court action becomes necessary, all court costs and fees will be added.
Terms of business (export)
VAT will apply unless a registration number and business address can be supplied. Goods will be delivered by mail, air freight or sea freight, depending on weight and urgency. Payment in advance against pro forma invoice or credit to authorised accounts only. Non EEC Countries – all supplies will be exempt if VAT. All other terms as above.
Terms of business (trade)
Trade terms only given to speedway/grass track retailers and engine tuners. Terms and condition as above will apply. All trade invoices to be paid within 30 days of invoice date. Motorcycles, engines and chassis to be paid before delivery.
We reserve the right to re-invoice any overdue accounts and remove any discounts. Overdue accounts will be persued by a debt collecting agency. Interest and all costs will be added to the claim. If court action becomes necessary, all court costs and fees will be added.
All products sold by Andy Smith Ltd. (Foxy Race Products), are sold as received, and with all faults. Racing is a dangerous activity. We will not be held responsible for any loss, damage, injury or death arising from the use of goods sold. The buyer assumes all risk for any and all damage caused to himself or third party, by the virtue of failure of these parts. We make no guarantee as to the products distributed by us, expressed or implied. We are not responsible for any warranty or guarantee made by any dealer, distributer, manufacturer, or other persons. No guarantee applies to any work carried out by Andy Smith Ltd. (Foxy Race Products) or by any person on behalf of Andy Smith Ltd. (Foxy Race Products). We will not be held responsible for any loss, damage, injury or death arising from any work done, negligence or failure. The buyer assumes all risks for damage caused to himself or any third party by virtue of failure of work carried out. All components must be installed by a qualified mechanic. Unskilled assembly of highly stressed racing equipment may result in failure and injury. Motorcycle racing is dangerous and the buyer must decide if components and labour are suitable for his requirements before use.
Cancellation and returns policy
If you wish to cancel your order
You can notify us by email to firstname.lastname@example.org before we have dispatched the goods to you; or where goods have already been dispatched to you, by returning goods to us in accordance with the terms below.
You can return goods you have ordered from us within 7 days of receipt for a full refund of the item only or exchange providing the item/s have not been opened, damaged or used. The costs of returning goods to us shall be borne by you.
Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.
All returns require a RMA Number (Return Merchandise Authorisation Number), this can be obtained by request via email at: email@example.com.
Please allow 7 working days to process. Returns will not be accepted without a RMA Number. Please give a detailed description with your return to help us process it quickly as possible.
